The Jax Mediation Center in connection with the Jacksonville Bar Association is proud to introduce the Residential Mortgage Foreclosure Mediation Program!

Pursuant to Administrative Order No. 2010-1 residential homestead foreclosure cases shall be referred to the Residential Mortgage Foreclosure Mediation (RMFM) Program. The Program is designed to facilitate communication between each of the parties in hopes of finding a mutually beneficial solution. Click here for a list of participating mediators.

Two bills, HB 1523 and SB 2270, which would allow banks to bypass the courts through a nonjudicial foreclosure process were proposed to the Florida Legislature earlier this year. These bills would allow banks to foreclose from 120 days to one year after an initial notice to property owners. Property owners would have to go to court to stop the nonjudical foreclosure. HB 1523 suffered a setback on April 12th, when the House Criminal and Civil Justice Policy Council failed to consider it. The next day, the Senate Banking and Insurance Committee failed to consider SB 2270, the counterpart to HB 1523. For the complete article from the Florida Bar News, click here.

While both of these bills died in Committee this year, we anticipate that they will appear again next year. To follow the progress of HB 1523, click here. To follow the progress of SB 2270, click here. We will continue to keep you updated on any further news.
